THE EDMONTON NATURE CLUB (ENC) RELEASE OF LIABILITY, INDEMNITY AND ASSUMPTION OF RISK (WAIVER OF CLAIMS) AGREEMENT FOR THOSE PARTICIPATING IN ENC EVENTS
BY AGREEING TO THIS WAIVER YOU GIVE UP YOUR RIGHT TO SUE FOR COMPENSATION FOR ANY INJURY, DEATH OR LOSS OF PROPERTY
PLEASE READ CAREFULLY!
In consideration of my being permitted to participate in or attend any meetings, field trips and other activities and/or functions (all of which are referred to hereafter as "the events") of The Edmonton Nature Club, I hereby, for myself, my heirs, assigns, personal representatives and next of kin, release and forever discharge The Edmonton Nature Club, its agents, volunteer leaders and other volunteers (all of which are hereafter referred to as “The Edmonton Nature Club”), from any and all lawsuits or actions, claims or demands by reason of any damage, loss, death or injury to myself or to my property arising from my participation in or attendance at the events due to any cause whatsoever, including any form of negligence by The Edmonton Nature Club, breach of contract or breach of any statutory or other duty of care, and also the failure to protect me from the risks, dangers and hazards of the events.
I agree to save, hold harmless and indemnify The Edmonton Nature Club from and against all lawsuits, claims, actions, cost or expenses in respect of any damage, loss, death, illness or injury to myself or to my property howsoever caused, arising out of or in connection with the events and regardless of whether the same may have been contributed to or occasioned by any form of negligence of The Edmonton Nature Club.
I recognize and acknowledge that in the events there are inherent hazards and risks which may include (this is not an exhaustive list): exposure to SARS-CoV-19 and hence risk of contracting COVID19 or other disease or illness, steep, uneven, slippery or jagged physical terrain; insects, dangerous plants and animals; changing and extreme weather conditions; exposed rock, earth or other natural or man-made objects; forest deadfalls; tree stumps; holes and depressions below the snow or ground surface; slippery ice; thin ice on frozen creeks, lakes and fens; cold water; deep streams or creeks; dense bush; poorly marked trails; vehicular traffic; negligence of other participants or attendees; the possibility of becoming lost as well as all other usual hazards associated with hiking, wilderness travel and the other pursuits of The Edmonton Nature Club. I agree to voluntarily assume all such risks and hazards, and I further agree to bear all costs of rescue or medical attention rendered to me personally arising from the events.
I recognize and acknowledge also that the above and following conditions, circumstances or conduct are my own responsibility and I freely accept and assume all the risks associated therewith: inappropriate clothing or footwear; inadequate physical fitness or health; intentionally or accidentally separating from the group activity; and failure to exercise good judgment or pay due care and attention.
I further recognize and acknowledge that I am entering into this agreement with The Edmonton Nature Club on its own behalf and on behalf of its officers, managers, servants, agents, volunteer leaders and other volunteers.

I have read the indemnity and release of liability and accept its terms. I also accept that I may receive information regarding ENC events and activities via email.
